TERMS AND CONDITIONS
The following is the terms and conditions and user agreement applicable for the use of services and products of Explarience Tours and Travels.
The word “ETT” used in terms & conditions means “Explarience Tours & Travels” and the website www.explarience.com.
Any person ("User") who inquiries about or purchases any products or services of ETT through its websites, mobile applications, salespersons, offices, call centres, branch offices etc. (all the aforesaid platforms collectively referred to as "Sales Channels") agree to be governed by this Agreement.
The User and ETT will be individually referred as ‘Party’ and collectively referred as ‘Parties’ in this terms and condition.
Any User purchases any products or services of ETT will accept the following terms and conditions. Before using any of the sales channels or procuring the services of ETT, the Users shall compulsorily read and understand this User Agreement, and shall be deemed to have accepted this User Agreement as a binding document that governs User's dealings and transactions with ETT. If the User does not agree with any part of this Agreement, then the User must not avail ETT's services and must not access or approach the Sales Channels of ETT.
The User must be atleast 18 years of age to become a User and use the services of ETT. If you are a minor or if you are below the age of 18 years, then you shall not register as a User of the Website and shall not transact on or use the Website.
We reserve the right to terminate your membership and/or block access to the Website if it is discovered that you are a minor or incompetent to contract according to the law or any information pertaining to your age entered at the time of creation of account is false.
ETT acts as a reseller in certain scenarios, ETT acts as a facilitator by connecting the User with the respective service providers like Activity, Attraction, Hotel, Rental, Permits, Holiday etc. (collectively referred to as "Service Providers"). ETT’s liability is limited to providing the User with a confirmed booking as selected by the User.
Any issues or concerns faced by the User at the time of availing any such services shall be the sole responsibility of the Service Provider Only. ETT will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on part of any Service Provider.
Unless explicitly committed by ETT as a part of any product or service:
- ETT assumes no liability for the standard of services as provided by the respective Service Providers.
- ETT provides no guarantee with regards to their quality or fitness as represented.
- ETT doesn't guarantee the availability of any services as listed by a Service Provider.
By making a booking, User understands ETT provides a website platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not ETT. Thus, the ultimate contract of service is between User and Service Provider.
User(s) are advised to check the description of the products and services carefully before making any bookings. User(s) agree to be bound by all the conditions as contained in booking confirmation or as shared in the confirmed booking voucher. These conditions are also to be read in consonance with this User Agreement.
If a User makes a booking on behalf of any of the family members or friends or another person, it shall be the responsibility of the User to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.
The User also authorizes ETTs representative to contact such user over email, SMS Message, WhatsApp and Email. This consent shall supersede any preferences set by such User through National Customer Preference Register (NCPR) or any other similar preferences.
While registering on the Website, the User will have to create a password to access that User's account. The User shall solely be responsible for maintaining the confidentiality of both the account, password and for all activities on the account.
It is the duty of the User to notify ETT immediately in writing of any unauthorized use or access of their password or account or any other breach of security. ETT will not be liable for any loss that may be incurred by the User as a result of unauthorized use of the password or account, either with or without the User's knowledge. The User agree and understands that any information that is provided to ETT Website may be read or intercepted by others due to any breach of security at the User's end.
ETT adopts the best industry standard to secure the information as provided by the User. However, ETT cannot guarantee that there will never be any security breach of its systems which may have an impact on User's information too.
The data of the User as available with ETT may be shared with concerned law enforcement agencies for any lawful or investigation purpose without the consent of the User.
In addition to the cost of booking charged by the Service Providers, ETT charge certain fees in the nature of convenience fees or service fees. This fee is non-refundable. ETT reserves the right to alter any and all fees from time to time without any prior notice. These fees be displayed to the User(s) before confirming the booking or collecting the payment from such User.
In cases of short charging of the booking amount, taxes, convenience fee or service fee or etc., owing due to any technical error or other reason, ETT shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to ETT paid before the utilization date. In any case if the User does not make the payment, then ETT reserve the rights to cancel the service for which booking was made.
Any increase in rate of taxes or imposition of new taxes, levies by Government after the booking shall have to be borne by the User only. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.
In any case of a booking not getting confirmed for any reason whatsoever, ETT will process the refund of the booking amount paid by the User and intimate the User about the same. ETT is not under any obligation to provide an alternate booking in or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions.
The User shall be completely responsible for all taxes, charges, duties, fees, and assessments arising out of the use of the service, as per the applicable laws
The User agrees and understands that all payments shall only be made to bank accounts of ETT online or offline. ETT or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of ETT. The User agrees that if that user transfers any amount against any booking or transaction to any other bank account that is not legitimately held by ETT or to any personal account of any person, ETT shall not be held liable for the same. User shall not hold any right to recover from ETT any amount which is transferred by the User to any third party.
The User will not share his personal sensitive information like Debit Card or Credit details includes card number, CVV, OTP, card expiry date or account ID, passwords etc. with any person including the agents, employees, or representatives of ETT. The User shall immediately inform ETT if such details are demanded by any of its agents' employees or representatives. ETT shall not be liable for any loss that the User incurs for sharing the aforesaid details.
Refunds, if any, on cancelled bookings will always be processed to the source or wallet from which payment was made for that booking.
ETT will send all booking related communications such as confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other relevant information for the transaction or booking made by the User, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.
ETT may also contact the User(s) through the above-mentioned modes for any pending or failed bookings, to know the preference of the User for concluding the booking and also to help the User for the same.
The User will be responsible to share the correct communications details such as email ID and or Mobile Number. ETT will not be responsible for any loss occurred by the User for wrong mobile number or email id provided for any reason whatsoever at the time of booking or creating an account.
ETT shall not be responsible for any kind of damages as an outcome of accident, illness, injury, or loss of personal baggage or even the cancellation of bookings. In no case ETT shall accept any claims arising out of such scenarios. It is advisable that the traveller should avail of a travel insurance at their own cost to tackle unforeseen events.
There can be certain circumstances where ETT and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, landslides, roadblocks, labor unrest, financial breakdown, epidemic, pandemic, business exigencies, government decisions, terrorist activity, any operational and technical issues, re-route and / or flight cancellations etc. or any other reason beyond the control of ETT.
If ETT has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to the User or refund the booking amount after deducting non-refundable convenience fee and or any other applicable service charges, if supported and refunded by that respective service operators. The user agrees that any difference amount for the alternative product or service provided will be borne by the User only.
The User agrees that ETT being online platform facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User must contact the Service Provider directly for any further resolutions and refunds.
The User agrees that in the event of non-confirmation of booking due to any technical reasons such as network downtime, disconnection with third party platforms such as payment gateways, wallets, banks etc. or any other similar failures, ETT’s will only refund the booking amount, if any, received from the customer. Such refund shall completely discharge ETT from all liabilities with respect to that transaction.
The User agrees that due to recent outbreak of COVID-19 which has been declared as pandemic, there may be instances, where the end service provider (including Travel Agent) either cancels the booking or refuses to provide the services, as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the User:
- Exhibiting any symptoms associated with COVID 19.
- Refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms etc.
- Suffering of any ailment making the User or traveller vulnerable to the virus
- Posing a threat to the health and safety of others.
Any other condition put forward by the Central Government, State Governments and statutory bodies etc. In such cases ETT will assume no liability for the refusal of service by the end service provider. The User also agrees that refund after deduction of the convenience fee and services charges, if any, for such bookings will be processed by ETT to the User subject to receipt of the same from the end service provider.
The User further understands that due to the outbreak of COVID-19, there may be frequent changes in guidelines and/ or SOPs issued by the Central Government, State Governments and statutory bodies etc. that a User will have to follow in order to undertake the travel as per the SOPs.
The User agrees to abide with all such guidelines/SOP while undertaking any travel. In case User fails to adhere to the same which results in the refusal to travel, ETT will not be held liable for such refusal and refund, if any, shall be strictly as per the terms of the service provider.
The User must share correct and valid information while making use of the ETT Website under this User Agreement, and not to make any misrepresentation of facts. Any incorrect information shared by the user with ETT can lead to the denial of services from ETT and may lead to cancellations without any prior intimation to the user. In such an event, ETT shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.
If any judicial, investigation agency, government authority approaches ETT to cancellation of any booking then ETT reserve the rights to cancel the same without approaching the concerned User. he User shall not hold ETT responsible for any loss or damage arising out of measures taken by ETT.
It is the responsibility of every User and or traveller to ensure that they must carry documents relevant for a particular tour, including passport and VISA and / or a valid ID card such as Aadhar Card, Voter Card, Driving License etc. This is especially important for guests coming from a different country. No refund can be done in the event of loss or lack of these relevant documents.
Travellers of any nationality are advised to check with their respective country´s consulates to gain information on entry requisites before they plan to book any services or products. The permit and VISA requirements are subjected to change and hence its vital to inquire with your consulate regarding the current visa and health requirements at youy own as they are subject to change without prior notice.
If the User is willing to amend or cancel his / her booking because of whatsoever reasons including death, accident, illness, epidemic or Pandemic or Lockdown or any other force majeure or any other personal reasons, the ETT is liable to recover Cancellation charges from the User. All cancellations are to be communicated in written via email or chat box provided in the website.
CANCELLATIONS
- Every Tour Activity, Attraction, Hotel, Rental, Permits, Holiday has its own cancellation policies. We request User to read them before booking any of the above mentioned with ETT.
- Amount paid for tourist Inner Line Permits for Ladakh or VISA is not Refundable once payment done at ETT website.
- While booking combo please make sure that all combo tours options are available. If not, you would only be able to enjoy the tours and services that you have seen in the options.
NO SHOW If you fail to turn up for the tour, no refunds in part or full can be provided. The same condition applies in the case of unused tickets, sightseeing tours, meals, car-rental or chauffeur-driven services. Likewise, rescheduling cannot be allowed for confirmed bookings.
AMENDMENTS Any amendment in the original booking must be given in writing via email. All changes will be processed only after the receipt of the same by ETT. However, if any of the amendment requests results in cancellation of one or more services, then the ETT is liable to recover cancellation charges as indicated in the cancellation policy of the particular services.
The above-mentioned cancellation charges are applicable only against the main Tour and optional tours published by the ETT. If the User has booked any other services such as air / train tickets or any third-party product, then the ETT is liable to recover cancellation charges as per cancellation terms of respective airline / railways or the cancellation terms of respective third party. ETT is also liable to recover its service charges against booking and cancelling such services for the User.
THINGS TO NOTE: -
- The vehicle used for transfers is not at disposal.
- It is mandatory to carry photo ID card while you are on tour.
- Cost Exclusion.
- Cost of any meals unless specified.
- Additional / Personal use of vehicle.
- Any extra excursions or sightseeing apart from the above specified itinerary.
- Camera fees, Guide charges or entry fees.
- Any incidental and other expenses which are not specified in the inclusions.
- Taxes as applicable.
- Early check-in or late check-out is subject to availability and may be chargeable by the hotel directly.
- In case of non-availability of hotels, similar category of hotels will be provided.
- No refund in case of natural calamity like-weather, road conditions, the physical ability of the participants etc.
Please Note: At the time of check out we don’t accept any cheques, any type of credit card or debit card (the final payment will made by cash only)
